Welcome to Scalefox ("we," "our," or "us"). By accessing or using our website, services, and applications (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

Scalefox provides AI-powered tools and services designed to help businesses optimize workflows, enhance productivity, and scale operations effectively.
 

1. Acceptance of Terms

By creating an account, using our Services, or otherwise accessing our platform, you confirm that you:

  • Have the legal authority to enter into these Terms

3. User Accounts and Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information

  • Maintain and update your information as necessary

  • Keep your account credentials secure and confidential

  • Notify us immediately of any unauthorized access

  • Accept responsibility for all activities under your account

 

4. Subscription and Billing

Our Services may be offered through various subscription plans. By subscribing, you agree to:

  • Automatic renewal of your subscription unless cancelled

  • Price changes with reasonable notice

 

Consumer Right of Withdrawal (EU/UK): You may withdraw within 14 days of purchase. If Services begin during this period, you may lose the withdrawal right once Services are fully performed. You may cancel anytime in account settings or by contacting contact@scalefox.com.

 

Upon cancellation:

  • Subscription remains active until the end of the current billing period

  • Paid features remain available until expiration

  • No refunds for partial billing periods (subject to statutory rights)

 

5. User Content and Intellectual Property

You retain ownership of content you provide ("User Content"). By using our Services, you grant us a license to:

  • Use, process, and analyze User Content to deliver Services

  • Generate derivative works based on User Content

  • Store and transmit User Content as needed

You represent that you have all necessary rights to your User Content. Violation may result in suspension or termination. All other content, including text, graphics, trademarks, software, and designs, are owned by Scalefox or licensors.

 

6. Acceptable Use Policy

You agree not to:

  • Upload or request NSFW or harmful content

  • Infringe intellectual property rights

  • Automate or misuse integrations against third-party policies

  • Upload malicious code or attempt unauthorized access

  • Engage in harassment, abusive behavior, or illegal activities

 

7. Platform Rules

Use of integrated platforms (e.g., APIs, third-party tools) is subject to their respective terms. Scalefox complies with official access policies and does not bypass restrictions.

 

8. Sanctions

We do not provide services to individuals or entities subject to applicable sanctions laws, including where prohibited by U.S. or international regulations.

 

9. Privacy and Data Protection

Your privacy is important to us. Use of personal data is governed by our Privacy Policy, incorporated by reference.

 

10. Disclaimers and Limitations of Liability

Our Services are provided "as is" without warranties of any kind. To the maximum extent permitted by law, Scalefox is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

 

11. Indemnification

You agree to indemnify and hold harmless Scalefox, its affiliates, and employees against claims, damages, or expenses arising from your use of Services, your breach of Terms, or violation of third-party rights.

 

12. Force Majeure

Scalefox is not liable for failure to perform obligations due to circumstances beyond reasonable control, including natural disasters, government actions, or internet outages.

 

13. Dispute Resolution

Contact contact@scalefox.com within 30 days of any issue. If unresolved within 60 days, disputes shall be settled by binding arbitration under the rules of the American Arbitration Association in Delaware, USA, in English. Arbitration decisions are final. Class action waivers apply.

 

14. Termination

Either party may terminate at any time. Scalefox may suspend or terminate accounts immediately for violations. Upon termination, rights to use Services cease immediately. Certain provisions (e.g., indemnity, disclaimers) survive termination.

 

15. Governing Law and Jurisdiction

These Terms are governed by the laws of Delaware, USA. Legal actions must be brought in courts located in Delaware.

 

16. Severability

If any provision is invalid or unenforceable, the remainder remains effective.

 

17. Entire Agreement

These Terms, along with our Privacy Policy, represent the entire agreement between you and Scalefox regarding Services.

18. Assignment

You may not assign your rights without our consent. Scalefox may assign freely.
